To publish a Section 35(5) notice the executor first lodges the Liquidation and Distribution Account with the Master and waits for approval. Once the Master is satisfied with the account permission is granted to advertise in terms of Section 35(5) of the Administration of Estates Act 66 of 1965. The notice then opens the account for inspection for 21 days.

Step 1 — Confirm Master approval
Do not publish a Section 35(5) notice before the Master grants permission to advertise. Publishing early means the notice must be repeated. The Master’s office FAQ confirms permission follows the Master being satisfied with the account.
Step 2 — Identify the correct offices
The account lies open at the Master’s office where the estate is registered and at the Magistrate’s office in the district where the deceased lived. The notice must name both. This connects to the Liquidation and Distribution Account lying for inspection step.
Step 3 — Publish a Section 35(5) notice
The J187 notice is published in an online newspaper that circulates in the relevant district and gives interested parties free access, in line with Chief Master’s Directive 1 of 2025. Government Gazette coordination is arranged where required. The inspection period runs 21 days unless a longer or shorter period is stated.
Step 4 — Keep the publication record
