Form J193 vs J187: What’s the difference in South African estate law?

When dealing with the administration of a deceased estate, it’s important to understand the difference between Form J193 and Form J187. Each form plays a key role at different stages of the estate process in South Africa — and using the correct one is a legal requirement.

What is Form J193?

Form J193 is a Section 29 notice to creditors. It is one of the first notices that must be published after you’re appointed as executor of an estate.

Purpose:

  • Alerts creditors to submit claims against the estate.
  • Notifies debtors to settle outstanding debts.

When it’s used:

  • After the Master of the High Court issues the Letters of Executorship.

Where it’s published:

  • In a local newspaper or approved digital publication and in the Government Gazette.

What is Form J187?

Form J187 is a Section 35 notice for the L&D (Liquidation and Distribution) account. This is published later in the process.

Purpose:

  • Notifies the public that the estate’s distribution plan is available for inspection.
  • Allows time for objections before payouts are made to heirs.

When it’s used:

  • After the L&D account is approved by the Master.

Where it’s published:

  • In the Government Gazette and a local or approved online publication.
